Court Declines to Hear Petition by Wiper Party Members
The Kitui High Court has declined to address a petition challenging the nomination of Prof. Kithure Kindiki as Deputy President. The petition was filed by two County Assembly Members (MCAs) from the Wiper Party:
- Cyrus Musyoka, MCA for Ikanga Ward
- Priscillah Martha Mukami, nominated MCA
Both MCAs are from Kitui County and raised concerns over Kindiki’s nomination.
Petition Redirected to Nairobi’s Milimani Law Courts
The Kitui High Court directed the petition to a three-judge panel at the Milimani Law Courts in Nairobi. This panel, led by Justice Eric Ogola, is reviewing various impeachment petitions. A ruling is expected on Thursday afternoon regarding:
- Extending or lifting conservatory orders issued by Justices Chacha Mwita (Milimani) and Richard Mwongo (Kerugoya)
- These orders halted the Senate’s impeachment of Deputy President Rigathi Gachagua, preventing Prof. Kindiki from taking office.

Statements from Gachagua’s Lawyer
Kibe Mungai, Gachagua’s lawyer, argued that the legal process has been unfairly influenced, stating:
“A process conducted by the legislative arm of the State has been converted into a Government Project.”
Court of Appeal to Review Gachagua’s Case
Meanwhile, the Court of Appeal is set to address Gachagua’s appeal on Thursday morning. This appeal disputes a prior ruling which upheld that Deputy Chief Justice Philomena Mwilu acted lawfully by appointing a bench to handle the impeachment case.

Gachagua Remains Hopeful for Justice
At a recent funeral in Limuru, Kiambu County, Deputy President Rigathi Gachagua expressed optimism regarding his legal case, encouraging calm and faith in the Judiciary:
“I want everyone to be calm as we await the legal proceedings to be determined. I believe the Judiciary is impartial and will uphold a fair hearing.”
