The High Court in Nairobi issued conservatory orders on Friday, halting the appointment of Kithure Kindiki as Kenya’s deputy president to replace Rigathi Gachagua.
In his ruling, Justice Chacha Mwita emphasized that the petition filed by Gachagua’s legal team raised significant constitutional issues that are crucial to the integrity of the constitution, including fundamental principles related to the rule of law and human rights.
Justice Mwita instructed the petitioner to promptly serve the application to the respondents and directed the respondents to file their responses within the next three days.

The judge noted that the petition poses substantial questions of law and public interest, warranting consideration by a bench of an uneven number of judges to be appointed by Chief Justice Martha Koome.
