Deputy Inspector General Gilbert Masengeli has issued an apology to the court and the Judiciary this afternoon for the circumstances that led to his conviction and sentencing.
While addressing the court, Masengeli clarified that his actions were not intentional. He explained to Justice Lawrence Mugambi that his focus had been diverted by pressing national security matters in northern Kenya, which required his undivided attention.
“I respect you and all our courts for the good work you do to uphold the rule of law. As a police officer, it is my duty to enforce court orders and ensure court orders are obeyed,” Masengeli said.
“I pray that this court accepts my apology and vacates conviction and sentence.”
Masengeli informed the court that efforts had been made concerning the disappearance of the Kitengela three, and investigations were still ongoing.
He emphasized that the Kitengela three were never in police custody but revealed he had learned earlier this morning from advocate Nelson Havi that the missing individuals had been found. Havi made the announcement during his submissions before the court.
“I am not above the law. I have obeyed court orders,” Masengeli stated, as he defended his right to continue serving in public office.
