High Court Judge Lawrence Mugambi has quashed the conviction and six-month jail sentence handed to Deputy Police IG Gilbert Masengeli.
Justice Mugambi acknowledged that Masengeli had shown genuine remorse for his actions by issuing an apology to the court to clear the contempt charge. He emphasized that the court’s primary goal was not to punish Masengeli, but to uphold its dignity through the sentence.
“In my observation, his apology appeared genuine. He was calm and polite. His conduct has restored the dignity of the court and administration of justice,” Mugambi said.
“I respect you and all your courts for the good work you do to uphold the rule of law. As a police officer, it is my duty to enforce court orders and ensure they are obeyed. I am deeply sorry,” Masengeli said.
Law Society VP Urges Strict Adherence to Leadership Integrity in Masengeli Case
Law Society of Kenya (LSK) Vice President Mwaura Kabata emphasized the importance of public officials upholding the constitution, particularly Chapter Six on leadership and integrity. He urged the court to make a ruling that would set a precedent for all individuals entrusted with public duties.
However, High Court Judge Lawrence Mugambi expressed satisfaction with Deputy Police IG Gilbert Masengeli’s explanation and apology. Despite this, Mugambi recused himself from the case following an application by the LSK and referred the matter to the Chief Justice, requesting the constitution of a bench to hear it further.
