Six judges whom former President Uhuru Kenyatta declined to appoint have been awarded Ksh. 126 million in damages. The judges—Joel Ngugi, George Odunga, Aggrey Muchelule, Weldon Korir, Judith Omange, and Magistrate Evans Makori—sought legal redress after being bypassed for their appointments in 2021.
The court ruled in their favor, granting each Ksh. 15 million in damages and an additional Ksh. 5 million as exemplary damages. It was determined that the former president was obligated to appoint them within a reasonable time, but failed to do so.
The judge noted that the delay violated the judges’ right saying that they ought to have been given written reasons as to why the president failed to appoint them.
The six were later sworn in by President William Ruto after he assumed office in 2022.
